Tenant Terms & Conditions

1. Introduction

These Tenant Terms & Conditions (“Terms”) govern your use of the Occupie platform and any booking of spaces through https://occupie.co.uk (“Platform”).

By making a booking or using the Platform, you agree to be bound by these Terms.

 2. Role of Occupie

Occupie provides a digital marketplace that connects users seeking short-term space (“Tenants”) with property owners (“Landlords”).

Occupie:

  • Does not own, lease, or manage any listed spaces

  • Is not a party to any rental agreement between Tenant and Landlord

  • Acts solely as an intermediary to facilitate introductions and payments

All rental agreements are made directly between Tenant and Landlord.

Occupie may operate certain aspects of the booking process manually during early stages of the platform.

 3. Bookings & Agreements

Bookings are initiated via the Platform. A booking is only confirmed once accepted by the Landlord and confirmed by Occupie.

Once a booking is confirmed, a direct agreement is formed between you and the Landlord. Occupie is not a party to this agreement and has no responsibility for its performance, enforcement, or outcome.

You are solely responsible for:

  • Ensuring that the space is suitable for your intended use;

  • Agreeing all necessary terms with the Landlord;

  • Complying with all conditions, rules, and restrictions set by the Landlord;

  • Ensuring your use of the space is lawful and compliant with all applicable regulations.

Occupie does not provide legal, contractual, or advisory services in relation to any agreement between you and the Landlord.

Occupie shall have no liability for:

  • Any terms agreed between you and the Landlord;

  • Any breach of contract by either party;

  • Any disputes arising from the agreement.

 4. Payments

All payments for bookings made through the Platform are processed by Occupie.

To secure a booking, the Tenant is required to pay the full Rental Fee in advance at the time of booking.

The Rental Fee is set by the Landlord and displayed on the Platform prior to booking.

By completing a booking, you agree to pay the full Rental Fee to Occupie.

Occupie collects payment on behalf of the Landlord and holds the funds until the expiry of the applicable cancellation period. Once the relevant cancellation deadline has passed, payment is released to the Landlord in accordance with the Platform’s payment process.

Payments are processed securely via a third-party payment provider, currently Stripe. By making a payment, you agree to the applicable terms of such payment provider.

Occupie is not responsible for any errors, delays, or issues arising from third-party payment providers.

Payments are non-refundable except where provided for under the applicable cancellation policy.

 5. Tenant Responsibilities

As a Tenant, you agree to:

  • Use the space only for agreed and lawful purposes

  • Comply with all applicable laws and regulations

  • Follow all rules provided by the Landlord

  • Leave the space in the condition it was provided

You are solely responsible for:

  • Your event, activity, and guests

  • Any equipment or installations

  • Obtaining appropriate insurance

 6. Liability & Risk

You acknowledge and agree that:

  • All spaces are used at your own risk

  • Occupie does not inspect or control any property

To the maximum extent permitted by law, Occupie shall not be liable for:

  • Damage to property

  • Personal injury or accidents

  • Any incidents occurring at the space

  • Actions of Landlords or third parties

  • Any loss, disruption, or failure of your event

 7. Cancellations

Cancellation policies are set by the Landlord and displayed on each listing. By making a booking, you agree to the applicable cancellation policy.

Where no policy is provided, Occupie’s default cancellation policies apply:

  • Flexible

    • Cancel 30 days or more before the booking start date → 80% refund of the Rental Fee

    • Cancel 7 days or more before the booking start date → 50% refund of the Rental Fee

  • Moderate

    • Cancel 30 days or more before the booking start date → 50% refund of the Rental Fee

  • Strict

    • Bookings are non-cancellable and non-refundable

Where no policy is selected, the Strict policy applies by default.

All cancellations must be submitted in writing.

Refunds:

  • Are subject to the applicable cancellation policy;

  • Will only be issued where required under that policy;

  • May depend on funds being returned by the Landlord where payment has already been released.

Where funds have already been released to the Landlord, refunds will only be issued once Occupie has received the relevant funds back.

 8. Listings Disclaimer

Occupie does not guarantee the accuracy, legality, or suitability of listings.

Landlords are solely responsible for the information provided.

 9. Prohibited Conduct

You must not:

  • Use spaces for illegal purposes

  • Misrepresent your booking

  • Circumvent the Platform

  • Cause damage or nuisance

 10. Limitation of Liability

To the maximum extent permitted by law, Occupie excludes all liability not expressly stated in these Terms.

Nothing in these Terms excludes liability for:

  • Fraud

  • Death or personal injury caused by negligence

 11. Governing Law

These Terms are governed by the laws of England and Wales.
