Tenant Terms & Conditions

1. Introduction

These Tenant Terms & Conditions (“Terms”) govern your use of the Occupie platform and any booking of spaces through https://occupie.co.uk (“Platform”).

By making a booking or using the Platform, you agree to be bound by these Terms.

2. Role of Occupie

Occupie provides a digital marketplace that connects users seeking short-term space (“Tenants”) with property owners (“Landlords”).

Occupie:

  • Does not own, lease, or manage any listed spaces

  • Is not a party to any rental agreement between Tenant and Landlord

  • Acts solely as an intermediary to facilitate introductions and payments

All rental agreements are made directly between Tenant and Landlord.

3. Booking Process

  • Tenants may submit booking requests via the Platform

  • A booking is only confirmed once accepted by the Landlord and confirmed in writing by Occupie. Payment arrangements may be processed through the platform or agreed separately during the booking process

  • The Tenant enters into a direct agreement with the Landlord upon confirmation

Occupie may provide standard agreement templates, but does not guarantee their suitability.

4. Payments & Fees

All payments for bookings are processed by Occupie.

The total amount payable by the Tenant consists of:

  • The rental price set by the Landlord (“Rental Fee”); and

  • A Tenant Service Fee equal to 7% of the Rental Fee, subject to a minimum fee of £30, charged by Occupie and added on top of the Rental Fee.

The Tenant Service Fee:

  • Is clearly displayed prior to payment;

  • Is retained entirely by Occupie;

  • Is not shared with the Landlord.

By proceeding with a booking, you agree to pay the full amount (Rental Fee + Tenant Service Fee) to Occupie.

Occupie collects payment on behalf of the Landlord and facilitates the transfer of the Rental Fee to the Landlord, subject to applicable deductions, including Occupie’s commission.

Service Fees are non-refundable unless explicitly stated otherwise.

5. Tenant Responsibilities

As a Tenant, you agree to:

  • Use the space only for agreed and lawful purposes

  • Comply with all applicable laws, regulations, and licensing requirements

  • Follow all rules provided by the Landlord

  • Leave the space in the condition it was provided

You are solely responsible for:

  • Your event, activity, and guests

  • Any equipment, installations, or setup

  • Obtaining any necessary insurance

6. Liability & Risk

You acknowledge and agree that:

  • All spaces are used at your own risk

  • Occupie does not inspect, control, or guarantee the condition or safety of any space

To the fullest extent permitted by law, Occupie shall not be liable for:

  • Damage to property (including your own or third-party property)

  • Personal injury, illness, or death occurring at a space

  • Any accidents, incidents, or safety issues during your booking

  • Actions or omissions of Landlords or third parties

  • Any loss, disruption, or failure of your event

You agree to indemnify and hold Occupie harmless from any claims, damages, or liabilities arising from your use of the Platform or any booked space.

7. Insurance

Tenants are strongly advised to obtain appropriate insurance, including:

  • Public liability insurance

  • Event insurance (if applicable)

Occupie does not provide insurance coverage for bookings.

8. Listings Disclaimer

  • Listings are created and managed by Landlords

  • Occupie does not guarantee accuracy, legality, or suitability

  • You are responsible for verifying that the space meets your requirements

9. Cancellations & Refunds

Cancellation policies are set per listing.

If no policy is displayed, the Strict policy applies.

  • Service Fees are non-refundable

  • Refunds are processed only after funds are received from the Landlord

10. Prohibited Conduct

You must not:

  • Use spaces for illegal or unsafe activities

  • Misrepresent your intended use

  • Circumvent the platform to avoid fees

  • Cause damage or nuisance

Occupie reserves the right to suspend or terminate access for breaches.

11. Platform Rules

  • Communication must remain respectful and lawful

  • Bookings must be completed through the Platform

  • Occupie may remove users or listings at its discretion

12. Limitation of Liability

To the fullest extent permitted by law, Occupie excludes all liability not expressly stated in these Terms.

Nothing in these Terms excludes liability for:

  • Fraud

  • Death or personal injury caused by negligence (where legally applicable)

13. Governing Law

These Terms are governed by the laws of England and Wales.
