Landlord Terms & Conditions
1. Introduction
These Landlord Terms & Conditions (“Terms”) govern your use of the Occupie platform and the listing of spaces on https://occupie.co.uk (“Platform”).
By listing a space or using the Platform, you agree to be bound by these Terms.
2. Role of Occupie
Occupie provides a digital marketplace that connects property owners (“Landlords”) with users seeking short-term space (“Tenants”).
Occupie:
Does not own, lease, or manage any listed spaces
Is not a party to any rental agreement between Landlord and Tenant
Acts solely as an intermediary to facilitate introductions and payments
All rental agreements are entered into directly between Landlord and Tenant.
3. Listing Your Space
By listing a space, you confirm that:
You have the legal right to rent or license the space
All information provided is accurate and not misleading
The space complies with all applicable laws, regulations, and safety requirements
Occupie reserves the right to:
Approve, reject, or remove listings at its discretion
Request additional information or documentation
4. Landlord Responsibilities
As a Landlord, you are solely responsible for:
The condition, safety, and legality of your property
Ensuring the space is suitable for its intended use
Managing access, supervision, and conduct during bookings
Providing clear rules and restrictions for Tenants
Complying with health & safety, fire, and licensing regulations
You remain fully responsible for your property at all times during any booking.
5. Bookings & Agreements
Bookings are initiated via the Platform. You may accept or decline booking requests at your discretion.
Once a booking is accepted, a direct agreement is formed between you and the Tenant. Occupie is not a party to this agreement and has no responsibility for its performance, enforcement, or outcome.
You are solely responsible for:
Entering into appropriate contractual arrangements with the Tenant;
Ensuring that all terms governing the use of your space are clearly agreed;
Protecting your legal and commercial interests;
Seeking independent legal advice where necessary.
Occupie does not provide legal, contractual, or advisory services in relation to any agreement between Landlord and Tenant.
Occupie shall have no liability for:
Any terms agreed between you and the Tenant;
Any breach of contract by either party;
Any disputes arising from the agreement.
6. Payments & Commission
All payments for bookings made through the Platform are processed by Occupie.
Occupie collects the full Rental Fee from Tenants in advance at the time of booking in order to secure the reservation.
Occupie will hold the funds until the expiry of the applicable cancellation period for the booking. Once the final cancellation deadline has passed, Occupie will release payment to the Landlord.
The amount paid by the Tenant represents the Rental Fee set by you.
From the Rental Fee, Occupie deducts a commission of 15%.
The remaining balance is then paid to you, typically around 7 days prior to the booking start date, reflecting the final cancellation deadline under the applicable cancellation policy.
You acknowledge and agree that:
Occupie will retain control of the funds until the relevant cancellation period has expired;
Payment will not be made to you until after this period has passed;
The timing of payment may vary depending on the applicable cancellation policy;
You remain responsible for honouring all confirmed bookings once payment has been released.
Occupie reserves the right to:
Delay or withhold payment where reasonably necessary, including in cases of disputes, cancellations, or suspected misuse of the Platform;
Recover any amounts paid to you in error or in breach of these Terms.
7. Cancellations
You are responsible for specifying a cancellation policy for your listing.
Cancellation policies must be clearly stated and made available to Tenants prior to booking. By accepting a booking, you agree to be bound by the cancellation policy associated with your listing.
Where no cancellation policy is provided, Occupie reserves the right to apply a default cancellation policy. Occupie’s default policies are categorised as:
Flexible
Cancel 30 days or more before the booking start date → 80% refund of the Rental Fee
Cancel 7 days or more before the booking start date → 50% refund of the Rental Fee
Moderate
Cancel 30 days or more before the booking start date → 50% refund of the Rental Fee
Strict
Bookings are non-cancellable and non-refundable
Where no policy is selected, the Strict policy will apply by default.
In the event of a cancellation, you agree to:
Comply with the applicable cancellation policy;
Honour any refunds due in accordance with that policy;
Return any funds to Occupie where required to facilitate a refund to the Tenant.
You acknowledge and agree that:
Payments may have been made to you in advance of the booking date;
Refund obligations may require repayment of funds already received;
Failure to comply with refund obligations may result in recovery action by Occupie and/or suspension from the Platform.
Occupie is not responsible for funding refunds where you have not returned the required amounts.
8. Liability & Risk
You acknowledge and agree that:
You are solely responsible for your property and any activity that takes place within it
Occupie does not control or supervise Tenants or their activities
To the maximum extent permitted by law, Occupie shall not be liable for:
Damage to your property caused by Tenants or third parties
Theft, loss, or damage to any items within the space
Personal injury, accidents, or incidents occurring at your property
Any disputes between you and a Tenant
Any loss of income, cancellations, or failed bookings
You agree to indemnify and hold Occupie harmless from any claims, damages, or liabilities arising from:
Your listing
The condition or use of your property
Any interaction or agreement with a Tenant
9. Insurance
You are responsible for maintaining appropriate insurance, including:
Property insurance
Public liability insurance
Occupie does not provide insurance coverage for any listed space or booking.
10. Listing Accuracy & Compliance
You must ensure all descriptions, images, and terms are accurate
Any restrictions, rules, or limitations must be clearly stated
Occupie is not responsible for any inaccuracies or omissions in your listing.
11. Prohibited Conduct
You must not:
Provide false or misleading information
Circumvent the platform to avoid commission
Discriminate unlawfully against Tenants
Use the platform for illegal purposes
Occupie reserves the right to suspend or remove your account for breaches.
Occupie reserves the right to suspend or remove your account at its sole discretion where it reasonably believes a breach of these Terms has occurred.
11A. Non-Circumvention and Fee Protection
You acknowledge that Occupie invests significant resources in introducing Tenants and facilitating bookings through the Platform.
Accordingly, you agree that:
Non-Circumvention
For a period of 12 months following the introduction of any Tenant to you via the Platform, you must not, directly or indirectly:
enter into any agreement with that Tenant; or
accept or facilitate any booking, licence, or arrangement with that Tenant
where such an arrangement would reasonably be considered to have originated through the Platform and would result in the avoidance of Occupie’s commission.
Fee Protection
Where a booking or transaction is completed between you and a Tenant introduced via the Platform (whether directly or indirectly), Occupie reserves the right to invoice you for:
the full commission fee that would have been payable had the booking been made via the Platform; and
any reasonable costs incurred in recovering such fees (including administrative and legal costs, where applicable).
Survival of Obligations
This clause shall survive termination or suspension of your account for a period of 12 months from the date of last introduction or interaction via the Platform.
11B. Enforcement
If Occupie reasonably believes that a breach of this clause has occurred, Occupie may:
invoice you directly for any commission due under this clause
offset any such amounts against future payments due to you
suspend your account pending investigation
take reasonable steps to recover outstanding amounts owed
12. Platform Rights
Occupie may:
Remove listings
Suspend accounts
Refuse service
at its sole discretion where necessary to protect the platform or users.
13. Limitation of Liability
To the maximum extent permitted by law, Occupie excludes all liability not expressly stated in these Terms.
Nothing in these Terms excludes liability for:
Fraud
Death or personal injury caused by negligence (where legally applicable)
14. Governing Law
These Terms are governed by the laws of England and Wales.
